Vapestics is intended exclusively for adults age 21 and older.
This page explains our age-verification procedures and important information concerning FDA regulation, nicotine warnings and product claims.
Adults 21+ Only
Federal law prohibits retailers from selling covered tobacco products to anyone under age 21.
This includes:
- E-cigarettes
- Vapes
- E-liquids
- Liquid nicotine
- Tobacco products
- Products containing nicotine from non-tobacco sources that are covered by federal tobacco law
The federal minimum age of sale for covered tobacco products is 21, with no military exception.
Website Age Gate
Visitors may be asked to confirm that they are at least 21 before entering vapestics.com.
The age gate is only an initial website control.
Submitting your date of birth through the website age gate does not replace transaction-level age and identity verification.
Age Verification at Checkout
For regulated orders, we may verify:
- Full legal name
- Date of birth
- Residential address
- Shipping address
- Other information reasonably necessary to verify age and identity
PACT Act requirements for covered delivery sales require the seller to obtain the purchaser's full name, date of birth and residential address and verify that information through an appropriate commercially available age or identity database.
Third-Party Verification Provider
We may use an independent age and identity verification provider.
Relevant information may be transmitted to that provider for verification purposes as described in our Privacy Policy.
Failed Automatic Verification
If verification cannot be completed automatically, additional information may be requested.
We will not knowingly fulfill an age-restricted order when required age verification has failed.
False Information
Providing false age, identity or address information may result in:
- Order cancellation
- Account restriction
- Future order rejection
Purchasing for Minors
Do not purchase age-restricted products for anyone under 21.
Adult Signature
Covered deliveries may require an adult to:
- Be at least 21 years old
- Be present at delivery
- Sign for the package
- Provide government-issued photo identification
Applicable delivery-sale requirements may require age proof from the person accepting covered tobacco-product shipments.
FDA Marketing Authorization
FDA regulates tobacco products, including electronic nicotine delivery systems and nicotine products that fall within its authority.
Marketing authorization is product-specific.
Authorization for one product does not automatically authorize another:
- Device
- Pod
- Flavor
- Nicotine strength
- Product configuration
FDA maintains public resources identifying tobacco products that have received marketing authorization. Product authorization status may change over time.
Vapestics may review, restrict, suspend or remove product listings in response to regulatory developments or compliance review.
FDA Authorization Is Not FDA Approval
FDA marketing authorization does not mean that a tobacco product is safe or "FDA approved."
Vapestics does not describe products as:
- FDA Approved Vape
- FDA Certified
- Safe Vape
- Healthy Vape
unless the specific wording is legally supported and permitted for the exact product and context.
Product Listings
The presence of a product on vapestics.com should not be interpreted as an endorsement by FDA.
Vapestics may:
- Remove products
- Suspend listings
- Limit destinations
- Update product information
based on regulatory developments, product eligibility or compliance review.
Nicotine Warning
For covered products and advertisements to which FDA's nicotine warning requirements apply, the applicable statement may include:
WARNING: This product contains nicotine. Nicotine is an addictive chemical.
Applicable warning requirements may include specific formatting, placement and presentation rules.
Warning requirements may vary depending on the product type, nicotine content and applicable law.
No Medical Advice
Vapestics does not provide medical advice.
Website content is provided for product and general informational purposes.
No Smoking-Cessation Claims
Unless specifically legally authorized for the exact product and claim, Vapestics does not represent products as:
- Smoking-cessation treatments
- Medication
- Disease treatment
- Disease prevention products
No Unauthorized Modified-Risk Claims
Vapestics does not make reduced-risk, safer, harmless or similar claims for tobacco or nicotine products unless the specific claim is legally authorized for the specific product.
Examples of claims that should not be assumed to apply include:
- Safer
- Healthy alternative
- Risk-free
- Harmless
- 95% safer
FDA maintains a separate Modified Risk Tobacco Product authorization process, and any authorized modified-risk claim applies only to the specific product and claim covered by that authorization.
Nicotine and Non-Users
Nicotine is addictive.
People who do not currently use tobacco or nicotine products should not begin using nicotine products based on marketing or content from Vapestics.
Pregnancy and Health Concerns
Individuals who are pregnant, nursing, have a medical condition, take medication or have concerns about nicotine exposure should consult an appropriate healthcare professional.
Product Safety
Vape devices and lithium-ion batteries can present risks including overheating, fire or explosion when damaged or improperly handled.
